17 Children Injured

Seventeen students and one staff member from Passaic School No. 11 were injured and transported to The Valley Hospital in Ridgewood Friday morning after two school buses collided.

The accident occurred just before 10 a.m. on Route 17 in Mahwah as four buses carrying 179 third graders and 19 staff members were traveling to Museum Village in Orange County, N.Y. for a field trip.

According to reports, one bus attempted to avoid debris in the road by coming to a quick stop. That caused the bus behind it to run into the back of the first bus.

The two buses had 89 students and nine teachers on board. Seventeen students and one staff member were transported to the hospital to be treated for minor, non-life threatening injuries that included bruises and scratches, according to Mahwah police.

Can a New Jersey School Be Held Liable for a Bus Accident?

Although the details of what caused the Passaic School No. 11 school bus crash remain under investigation, those who were injured in the collision may have a right to compensation for their pain and suffering, medical bills, and more.

If a bus driver’s negligent actions, such as speeding, driving while distracted, driving too closely to other vehicles or another unsafe action, caused the school bus accident, the school district may be liable for the resulting damages.

According to the New Jersey Tort Claims Act, government entities in the state of New Jersey, such as the school board, waive their right to immunity from lawsuits arising from the negligent actions of the government entity or any of its employees, including bus drivers.

This means, you have the right to file a personal injury lawsuit against the school board, and any other liable entities, seeking compensation for your child’s suffering.

It may also be possible to hold others parties, such as a private school bus operating company, liable if the buses were owned and operated by a private company or if the driver worked for a private company that was hired by the school district.

Our school bus accident lawyers will thoroughly investigate the accident to determine the exact cause of the collision and all parties that could be held liable for the injuries your child sustained.
