Victims of hit-and-run accidents may not realize that their actions in the moments and hours after the crash can affect their chances of obtaining all the compensation they deserve.
After a hit-and-run crash, consider taking the following steps to help document what happened and preserve your claim:
You need to quickly focus if you want to have a chance of catching the fleeing driver. This is because you will probably have just a few seconds to get a look at the other car and its driver before it is out of view. You will need to collect as much information as you can so the police will have the best chance possible of finding the car and its driver.
Watch the car and quickly jot down as many details as possible, such as the make, model, color and license plate number of the vehicle. You should also note which parts of the car were damaged from the crash and the direction the car was headed.
If you can see the driver, write down any identifying characteristics you see, such as:
Even though you are angry and want to catch the driver who fled the scene, leave the chase to the police who have experience with these types of situations.
The other driver could be dangerous – he or she may have fled because the police have an outstanding arrest warrant. The police are trained to deal with dangerous individuals.
It is also their job to find people who flee the scene of a car accident, because it is a violation of state law. Under New Jersey Revised Statutes 39:4-129(a), any driver knowingly involved in an accident that caused injury or death must remain at the scene until fulfilling the requirements under subsection (c). This section requires the driver to present his or her driver’s license and vehicle registration to the victim and the police. The driver must also give his or her name and address to the victim and police.
Another reason not to chase the other driver is that it might not be safe to do so. If your vehicle was damaged in the crash, it might be unsafe to operate.
Pull out your smartphone and start taking pictures to document the scene. This includes taking pictures of the following:
You should also keep an eye out for any witnesses, including bystanders or customers or employees of local businesses. Ask them what they saw and take notes. Make sure to get the names and contact information for all witnesses so you can contact them again in the future.
Look around for any cameras that may have captured the accident. Note where these cameras are for future reference. A New Jersey car accident lawyer may be able to obtain footage from these cameras, which could be crucial to obtaining compensation from your claim.
After watching the car flee the scene, call the police to report that you were in an accident and the other driver fled. Give the dispatcher all of the information you collected about the other driver. This will be relayed to officers who may be able to catch the driver.
Whether they catch the driver or not, police will come to the scene of the accident to complete an accident report. Provide them with all of the information you have collected and explain what happened.
Ask the officer how you can obtain a copy of the report, as it is a vital piece of evidence for your insurance claim or personal injury lawsuit. It serves as an official record of what happened and helps link your injuries to the crash.
You need to be evaluated by a trained medical professional to diagnose all of your injuries and begin treatment. It is important to be examined by a trained physician because he or she can discover injuries you may not have known about because they weren’t immediately causing symptoms. For example, you might not notice symptoms of whiplash for hours or days after the crash.
The doctor will note all of your injuries and your treatment plan in your medical records. Your records will also note that your injuries were caused by the crash.
Our New Jersey hit-and-run accident attorneys understand the difficulties of collecting fair compensation after a hit-and-run crash. We are prepared to guide you through every step of the process, pursuing all compensation to help you get back on your feet.

Car insurance claims in New Jersey are governed by a no-fault system, which means accident victims must first seek compensation from their own insurance policy, even if they were not at fault for the crash. This also applies to hit-and-run accidents, regardless of whether the police find the other driver or not.
You should contact your insurance company as soon as possible after the accident. Explain that you were in a hit-and-run accident, the police have been contacted and are searching for the driver, and you are going to get medical treatment.
Stick to the basic facts and nothing else. Avoid discussing your opinions or attempting to gauge the severity of your injuries. Insurance companies will do whatever they can to deny or devalue a claim and giving incorrect information could hurt your chances of recovering compensation.
There are various coverages that could provide compensation for a hit-and-run accident, depending on whether or not the police find the driver who fled the accident scene.
If the other driver is found and he or she is insured, our New Jersey hit-and-run accident lawyers can pursue compensation from your collision and personal injury protection (PIP) coverages, up to the limits of your policy. Collision coverage provides compensation for damage to your vehicle while personal injury protection compensates you for:
Most New Jersey drivers choose to purchase the standard auto insurance policy, which requires you to have at least $15,000 per person per accident in PIP coverage. Drivers can purchase up to a maximum of $250,000.
Unfortunately, there are many times where police are unable to locate the driver who left the scene of an accident.
When this happens, you can still pursue compensation for medical expenses through your PIP coverage, as this is available regardless of who caused the accident. However, you may also be able to pursue compensation from your uninsured/underinsured motorist coverage. This provides compensation for property damage and medical expenses from the crash, up to the limits of your policy.
You can also obtain compensation from this coverage if police find the driver but the individual either has no insurance or lacks enough coverage to pay for your damages. This often happens in hit-and-run cases – the reason many people flee accidents is because they have no insurance.
Our hit-and-run accident lawyers in New Jersey know how to determine what types of insurance coverage are available to you after a hit-and-run accident.
Schedule a free legal consultation with us today to discuss your options.
While most car accident cases are resolved through car insurance claims, some victims may be able to file a personal injury lawsuit to recover certain forms of compensation. In a hit-and-run accident, this option only exists if police find the driver who left the scene of the crash.
If you chose to purchase the standard car insurance policy, you were required to make a choice about having a limited right to sue or an unlimited right to sue. Both options have different rules about when you can file a lawsuit and the forms of compensation you can pursue.
If you selected an unlimited right to sue, you can file a lawsuit against the at-fault driver to obtain compensation for pain and suffering for any injury, no matter how minor or severe. You will still have to pursue other forms of compensation through a car insurance claim.
When you select this option, it applies to your spouse, children and other relatives who are living with you and are not covered by another car insurance policy.
If you chose the limited right to sue option, you can only sue for pain and suffering if you sustain one of the following permanent injuries:
There is some leeway with the definition of a permanent injury, which means it is up to interpretation by a court. This means you could still have a right to sue for many types of severe injuries.
A New Jersey hit-and-run accident attorney from the Lynch Law Firm, PC can determine if you have the right to sue for your injuries. Our goal is to help you obtain all forms of compensation you are entitled, through the insurance claims process or filing a personal injury lawsuit.

New Jersey Revised Statutes § 39:6A-4 requires that all New Jersey auto insurance policies include PIP coverage, which provides you and or other passengers in your vehicle compensation after being injured in an auto accident.
PIP coverage is often referred to as “no fault” coverage because it is available regardless of who was at fault for the accident. This means, even if you caused an accident, your injuries will be covered by PIP. It also means that if you are injured in an accident caused by another driver, your injuries will be covered by your own PIP coverage.
There are two types of New Jersey PIP coverage you can purchase:
The additional allowance of coverage for certain injuries only applies to permanent or significant brain injury, spinal cord injury, disfigurement, or medically necessary treatment of other permanent or significant injuries provided at a trauma center or hospital immediately after an auto accident. The extended coverage will last until your condition is medically stable and no longer requires critical care.

New Jersey PIP protection coverage will provide you compensation for your medical treatment and financial losses after an auto accident. Specifically, this includes compensation for:
Depending on the amount of PIP coverage you purchased, you can be compensated for the full cost of your medical services and treatment. This includes reasonable and necessary expenses for:
Motorists who have purchased PIP coverage may obtain compensation for the income they lost while recovering from an auto accident injury.
The amount of compensation you can receive will vary based on the PIP policy you purchased. If you purchased the default minimum $15,000 policy, you will be provided a maximum weekly payment of $100, with a maximum limit of $5,200 on account of injury to any one person in any one accident.
However, you will need to provide your insurer with documented proof that shows you have suffered lost income due to the accident. This includes employment records, such as your paychecks or time cards, which detail your average earnings and the number of hours you typically work each week.
Furthermore, the compensation you receive for lost income will likely extend for as long as your injury has disabled you from working or until your PIP benefits have been exhausted.
In New Jersey, motorists who purchased PIP coverage are entitled to compensation for essential services benefits if they are injured in an auto accident.
This includes reimbursement for necessary and reasonable expenses incurred for essential services ordinarily performed by the injured victim for his or her self, family and member of the victim’s family residing in his or her household.
Typically, these benefits are limited to $12 per day with a maximum limit of $4,380 for the total period of the disability.
In the event that a victim dies in an auto accident, his or her PIP coverage will pay benefits if the victim was a provider of income to his or her dependents. This may include two types of lump-sum benefits:
To receive PIP death benefits, you are not required to show proof of actual loss or actual cost incurred after the decedent’s death. You are only required to show proof that you were financially dependent on the decedent, and that he or she was a provider of essential services.
Furthermore, the decedent’s estate may be entitled to a maximum of $1,000 for expenses related to the decedent’s funeral, burial or cremation.

New Jersey is a no-fault state, which means your medical treatment and lost wages will be compensated up to the amount of PIP benefits you purchased in your auto insurance policy. If the cost of your medical treatment or lost wages exceeds your PIP protection limits, you may be able to file a lawsuit against the at-fault party that caused your accident.
Filing a personal injury lawsuit may help you obtain additional compensation for noneconomic damages, like pain and suffering. However, your ability to file a lawsuit depends on the terms of your PIP policy and whether you chose the unlimited or limited right to sue.
If you chose the unlimited right to sue, you will be able to file a lawsuit against the at-fault party liable for your car accident for additional compensation that is not covered by your policy. This may include compensation for:
If you chose the limited right to sue option, or purchased a basic policy, you have agreed not to sue the at-fault party who caused your car accident for pain and suffering unless you sustain a permanent injury, such as:
However, choosing the limited right to sue option does not affect your ability to file a lawsuit for economic damages, such as medical expenses and lost wages.

New Jersey gives “sovereign immunity” protection to governments and governmental agencies, which protects them from personal injury lawsuits. This means the government cannot be held liable for a personal injury. It covers:
However, there are exceptions to the sovereign immunity rule as provided in the New Jersey Tort Claims Act (NJTCA), Chapter 45 § 59:1-1. This means there are situations where the government can be held liable for a school bus accident, city bus accident or other situation involving a negligent government employee.
If you intend to file a claim against the government, you must notify the appropriate agency within 90 days of the incident. If you miss this deadline, you likely will not be able to file a claim.
Because of this, you should contact our New Jersey bus accident lawyers as soon as possible so we can review the details of your claim and determine whether you have a case. We are familiar with the process for handling these types of cases and will guide you through every step.

As New Jersey is a no-fault state, the answer to this question is generally yes – you may be able to file claim against the personal injury protection (PIP) coverage in your own insurance. In a no-fault state, car insurance companies cover some damages no matter who is found to be at fault for the crash. New Jersey also requires drivers to purchase liability insurance, so your lawyer may be able to file a claim against the other driver’s liability coverage.
While most claims are resolved by recovering compensation from insurance companies, sometimes your lawyer will need to file a lawsuit to obtain compensation. However, the type of policy you purchased affects your ability to file a car accident lawsuit.
As car insurance claims can quickly become complicated, it is important to discuss your accident with an experienced New Jersey car accident lawyer.
Lynch Law Firm, PC offers a free, no-obligation legal consultation.
Unless you are more at fault than the other driver, you could still pursue compensation for your car crash injuries. New Jersey uses a comparative negligence law in situations where the victim is partially at fault. The law says your compensation award will be reduced by your percentage of fault. When you are more at fault than the other driver, you are barred from seeking compensation.
As insurance companies will try to apply this law to deny you compensation, it is important to discuss the situation with a licensed attorney. At Lynch Law Firm, PC, we are ready to build a strong case to try to prevent the insurance company from assigning you more fault than you deserve.
However, there are times when victims may think they are partially at fault when they are not. If you have questions about your own role in the accident, you should save them for your confidential consultation with an experienced attorney. Telling the insurance company about your concerns could hurt the value of your claim.
Our firm is committed to pursuing maximum compensation for our clients. We know compensation can never change what happened, but it is an important part of the recovery process after an accident. Without compensation, you may not be able to afford the medical treatment recommended by your doctor and the long-term effects of your injuries could be much worse than they otherwise would be.
Compensation can also help keep you and your family out of a financial crisis, if you are unable to work or earn as much money as you used to because of your injuries.
Some common forms of compensation for car crash victims include:
While there are no guarantees in the legal process, injury victims who hire attorneys often recover more compensation than those who do not.

We have the legal team and resources to thoroughly investigate, gather evidence, build a strong case and prepare for the courtroom if necessary.

Insurance companies will do everything they can to diminish, devalue and even deny your claim – they are only focused on their profits. We know the tricks and tactics they use to try to avoid providing compensation to crash victims. Our experienced attorneys have obtained compensation from many insurance companies.
We are dedicated to the best interests of our clients at every stage of the legal process. We are also prepared to take a case to trial if the insurance company does not offer fair compensation.
New Jersey is a no-fault state, so drivers often turn to their own insurance first to attempt to obtain compensation. The state requires all drivers to purchase at least $15,000 in PIP coverage, but many drivers purchase more than the minimum.
PIP coverage may provide the following benefits to accident victims:
New Jersey law states PIP coverage reimburses victims of covered auto accidents for the cost of reasonable and necessary medical, surgical, rehabilitative and diagnostic services. This includes the cost of ambulance services and other transportation and medication.
A treatment is considered medically necessary when it fits three criteria:
PIP coverage may pay for non-medical expenses if they are prescribed by the doctor to treat permanent or significant brain or spinal cord injuries or disfiguring injuries. Examples of non-medical expenses may include the cost of things like:
Car crashes often result in injuries that make victims unable to go back to work. Fortunately, your PIP coverage may pay for lost wages while you are out of work. The amount you receive will be based on your income and the terms of your policy.
If your injuries leave you unable to do essential services around the house, you may be eligible for compensation to cover the cost of hiring someone to help with those tasks. For example, you may need to hire someone to shovel snow, do laundry, mow the lawn or clean things around the house. PIP policies provide $12 per day for those tasks.
When a car crash causes a policyholder to die, and he or she was the family’s income provider, next of kin may receive death benefits (the maximum payout from lost income and essential services benefits). Payment goes to the surviving spouse. If there is no spouse, it goes to the children. If there are no children and no spouse, payment goes to the estate. Next of kin can also seek compensation for funeral expenses. A standard new Jersey PIP policy provides up to $1,000 for funeral expenses.

Our New Jersey auto accident lawyers are ready to discuss this with you in a free consultation. Drivers are required to purchase a minimum amount of liability coverage for damages from a crash they cause:
While these are the minimum requirements, drivers often purchase higher amounts of coverage.
If you were involved in a hit-and-run accident and the police are unable to locate the driver, or you were involved in another type of accident and the driver does not have insurance, your lawyer may be able to file a claim against the uninsured motorist coverage in your own insurance policy.
Standard auto insurance policies are required to have this coverage. It cannot exceed the amount of liability coverage you selected when purchasing your car insurance policy.
Uninsured motorist coverage may also provide compensation if you are injured in a crash with a driver who has less coverage than your amount of underinsured motorist coverage.
These types of claims are often complicated, as there are often requirements that must be met before you can obtain coverage. That is why talking to an attorney can be an important step after a crash.
Generally, your lawyer will be able to obtain insurance compensation. However, in some cases, the insurance company refuses to offer fair compensation for the victim. That is why our attorneys are always prepared to go to court to pursue maximum compensation.
That said, the type of insurance policy you purchased will affect our ability to file a lawsuit to recover compensation for pain and suffering. If you purchased a standard policy with a limited right to sue, your lawyer cannot claim pain and suffering in a lawsuit unless you died, suffered a permanent injury or one of the following injuries:
Basic policies also limit accident victims’ right to sue after a car accident.
However, if you purchased a standard policy with an unlimited right to sue, you could file a lawsuit to claim pain and suffering for any type of injury.
New Jersey’s statute of limitations for personal injury claims, including car accident claims is two years from the date of the crash. That means most victims have just two years to file a lawsuit over their crash. If you file after those two years pass, your claim is likely to be dismissed in court.
There are exceptions to this standard deadline, which is why you should strongly consider talking to a licensed New Jersey car accident lawyer about your claim.

One person was killed and 19 were injured after two NJ Transit buses collided in Newark Friday morning.
Reports indicate that the accident happened at 6 a.m. and that it appeared as though one of the bus drivers ran a red light and t-boned the other bus at the intersection of Raymond Boulevard and Broad Street.
The bus that was hit flipped onto its side upon impact and nearly split in half before coming to rest on a median. That bus was carrying 19 passengers at the time of the accident. All passengers, including the bus driver, were hospitalized with injuries. Seven people remain in critical condition.
The other bus was empty except for the driver and was lodged into the undercarriage of the t-boned bus. The driver died at the scene of the accident.
As with most accidents, it appears as though this NJ Transit bus accident could have been avoided if the bus driver had not run the red light. Although the circumstances surrounding the accident remain under investigation, those who were injured or lost a loved one in the accident may have a legal claim and may be entitled to compensation.
Our Newark bus accident lawyers are experienced in handling accident claims on behalf of those injured or killed in large transit accidents. We understand the complexities that often arise in dealing with a government entity such as the NJ Transit.

Because there is only a limited amount of time to file a claim with NJ Transit, it is vital that you contact our Newark bus accident lawyers immediately to discuss your legal options. We will guide you through the entire process and will work to help you recover the maximum compensation you deserve.
Your consultation is free and we do not charge any legal fees or other costs unless a recovery is made on your behalf.

Because New Jersey has experienced an unusually high rate of pedestrian accidents compared to other states across the nation, the state’s Division of Highway Traffic Safety has devised special programs for education, enforcement and engineering to help reduce the number of these accidents.
One of these initiatives was to create stricter rules about crosswalks. Before April 2010, New Jersey law required motorists to simply yield to pedestrians in a crosswalk; but since then, all motorists must stop for pedestrians who are in a marked crosswalk.
Likewise, if a vehicle is stopped for a pedestrian at a marked crosswalk and another vehicle approaches from behind and passes the stopped vehicle, the driver of the passing vehicle can be given a citation by the authorities.
Vehicles must also stop for pedestrians crossing at an unmarked intersection.
However, outside of these situations, pedestrians must give vehicles the right of way. Pedestrians should only cross a street using a marked crosswalk if one is available. They must also obey all pedestrian signals and signs, and they should not walk into the path of a vehicle if the vehicle does not have time to stop.
Any violations of these laws will be important for determining liability for a pedestrian accident. This means there are situations where a motorist is solely at fault for an accident, where a pedestrian is at fault, or where both parties share some responsibility for the accident.
Your New Jersey pedestrian accident lawyer will review the details of your accident to determine who is liable for your injuries.
If you were injured as a pedestrian, your attorney will take care of the details for you and negotiate with the insurance company for the compensation that is owed to you. Our New Jersey pedestrian accident attorneys have decades of successful experience helping our clients obtain maximum compensation for their injuries, and we can apply that experience to your case as well.

When a pedestrian is struck by a vehicle, he or she may experience injury in many different parts of his or her body, including:
It is important that the victim of a pedestrian accident seek immediate medical attention after the accident so any possible injuries are found and diagnosed. Depending on where on the pedestrian’s body he or she was hit and how severe the strike was, the victim may experience immediate or delayed pain, so it is important to have the injuries documented by medical professionals.
A pedestrian who is injured must keep these medical records for pursuing compensation from the at-fault party. Otherwise, the at-fault party’s insurance company may try to claim that the pedestrian’s injuries were caused by something other than the accident.

Seventeen students and one staff member from Passaic School No. 11 were injured and transported to The Valley Hospital in Ridgewood Friday morning after two school buses collided.
The accident occurred just before 10 a.m. on Route 17 in Mahwah as four buses carrying 179 third graders and 19 staff members were traveling to Museum Village in Orange County, N.Y. for a field trip.
According to reports, one bus attempted to avoid debris in the road by coming to a quick stop. That caused the bus behind it to run into the back of the first bus.
The two buses had 89 students and nine teachers on board. Seventeen students and one staff member were transported to the hospital to be treated for minor, non-life threatening injuries that included bruises and scratches, according to Mahwah police.
Although the details of what caused the Passaic School No. 11 school bus crash remain under investigation, those who were injured in the collision may have a right to compensation for their pain and suffering, medical bills, and more.
If a bus driver’s negligent actions, such as speeding, driving while distracted, driving too closely to other vehicles or another unsafe action, caused the school bus accident, the school district may be liable for the resulting damages.
