Bard IVC Filter Lawsuit Information

Bard inferior vena cava (IVC) filters are small cage-like devices that are implanted in the inferior vena cava to prevent blood clots from moving from the lower body into the heart or lungs. Unfortunately, the brittle design of these devices has caused many to fracture and cause serious internal injuries.

Anyone who has suffered from organ perforation, pierced veins or who has died after having one of these devices implanted, may be entitled to compensation through an IVC filter lawsuit. Contact the experienced class action lawyers at Lynch Law Firm, PC today for a free, no obligation consultation to determine if you are entitled to compensation.

The Dangers of IVC Filters

IVC filters are designed to prevent blood clots that originate in the lower body from traveling to vital organs like the heart and lungs, where they can be fatal. They are generally implanted in the inferior vena cava in patients who are at a high risk for blood clots but are not able to take blood thinner medications.

Although intended to protect patients from harm, poor design has led many patients to suffer additional life-threatening injuries. Some common complications include:

  • Punctured blood vessels, organs or tissues
  • Device migration to the heart, lungs, or brain
  • Chronic pain
  • Infection
  • Respiratory issues
  • Hemorrhaging
  • Ventricular tachycardia
  • Hematoma at the puncture site

If you have experienced any of these dangerous side effects or injuries, you should seek immediate medical attention. It is also in your best interest to contact a reputable attorney to explore your options for filing an IVC filter lawsuit.

IVC Filter Warnings

Over a five-year period, from 2005 to 2010, the U.S. Food and Drug Administration (FDA) received approximately 1,000 adverse event reports regarding IVC filter complications.

Because of this, the FDA released a safety communication in 2010 highlighting the complications associated with the device, including:

  • 328 device migrations
  • 146 detachments of pieces of the device
  • 70 perforations of the inferior vena cava
  • 56 device fractures

In 2014, the FDA issued another safety communication recommending that retrievable IVC filters be removed as soon as the risk of blood clots has cleared. It concluded that the risks outweigh the benefits for some patients.

Failure to Warn of Risks

An NBC News report in 2015, claimed that CR Bard, a major manufacturer of IVC filters, knew about the risks associated with its “Bard Recovery” IVC filter but failed to inform the public.

According to the report, a study commissioned by the manufacturer showed that the device maker knew in 2004 that its device was more dangerous than other IVC filters. According to NBC, the study showed that when compared to its competitors, the recovery device fractured, migrated and caused patient death at a higher rate than other similar devices.

The Bard Recovery IVC filter was fast-tracked for approval by the FDA for its substantial similarities to other devices that were already on the market. The device was approved under the assumption that it was as safe as other IVC filters.

Unfortunately, since it was first approved, many patients have experienced life-threatening complications and even death. If you have been injured or if a loved one has died after having a Bard IVC filter implanted, you may be entitled to compensation through an IVC filter lawsuit.
