Jim Lynch’s client, a 73-year-old woman, underwent cataract surgery. She lost vision in her eye after the surgery. Unfortunately, she died from unrelated causes before the trial. The defense argued that their surgeon did nothing wrong, and that the vision loss came from an unrelated stroke of the eye that “coincidentally” occurred shortly after surgery.
The defense offered $75,000.00 to settle the matter. Jim rejected this offer.
At trial, through expert testimony, Jim successfully proved that the surgeon failed to properly manage the complication of a dropped lens into the vitreous, which resulted in unchecked increased ocular pressure. As a result, increased pressure caused undue pressure on her optic nerve. This pressure on her optic nerve cut of the blood supply to the nerve and caused her blindness.
The jury agreed with Jim and found 100% for the estate of the plaintiff. The verdict and judgment was $710,000.000.
